General Terms and Conditions of our Online Shop

1. Scope of validity

These General Terms and Conditions (hereinafter referred to as “GTC”) apply to all orders submitted and contracts concluded (hereinafter referred to as “orders”) via the online shop salz.ch of Swiss Saltworks AG (hereinafter referred to as «Swiss Saltworks»).

2. Offer

The offer is addressed to natural persons who are resident in Switzerland or Liechtenstein (hereinafter referred to as «Customers»). Orders are only delivered to addresses in Switzerland and in Liechtenstein.

An offer is valid for as long as it is available in the online shop and/or for as long as stocks last. Prices and product ranges are subject to change at any time. The images shown in advertisements, brochures, the online shop, etc. and all product information are used for illustration purposes only and are non-binding. The specific information provided on the product packaging applies.

Orders for volumes that exceed normal household needs can be rejected without having to provide any reasons.

3. Price

Prices are expressed in Swiss francs and include value added tax (VAT) and, where applicable, advance recycling fees (hereinafter referred to as “ARF”).

The price shown in the online shop on the date of the order applies.

Delivery costs are listed separately on the invoice.

4. Order

The display of products in the online shop does not constitute a legally binding proposal, but serves as a non-binding online catalogue or non-binding invitation to Customers to order a product from the online shop. Swiss Saltworks reserves the right to limit delivery volumes for certain products and to refuse to make a delivery if the order is unusually heavy (> 30 kg) or bulky.

An order is interpreted by Swiss Saltworks as an invitation to enter into a contract.

A minimum order value of CHF 20 plus delivery costs applies.

After sending the order, the Customer automatically receives a receipt of confirmation to document that Swiss Saltworks has received the order. Customers can only add items to or cancel their order until it is processed. If items are added to an order, the original order serves as the basis for calculation, and any special offers and discounts offered when additions are made to the order are not taken into account.

Swiss Saltworks is authorised to refuse orders in whole or in part without having to provide any reasons. Customers will be informed of such a decision and any payments already made will be returned. All further claims are excluded, and the undeliverable products will not be delivered subsequently. Products that are temporarily undeliverable cannot be booked for later delivery.

5. Conclusion of contract

A contract is only concluded when the order is processed by the Logistics Centre of Swiss Saltworks. When the order is ready for despatch by the Logistics Centre, the Customer is sent an order confirmation by e-mail.

6. Delivery

The Customer's delivery address must be in Switzerland or in the Principality of Liechtenstein.

Delivery periods

Deliveries are sent by Post Pac Economy.

The goods are usually delivered within 9 working days at most (excluding public holidays) from the date of the order confirmation. Although it is very important to Swiss Saltworks to provide exact details about availability and delivery periods, production or delivery bottlenecks may cause delays in delivery. All information about availability and delivery periods are therefore non-binding and may change at any time.

No deliveries are made on Sundays and official national or cantonal public holidays.

Customers accept responsibility for the delivered products, also if they do not personally take receipt of these products.

The goods are delivered by the Dispatch department or by a courier. Please contact us in advance at +41 61 825 51 15 or by e-mail at ksc@saline.ch.

No delivery costs are charged for orders of CHF 100 or more, provided that the total weight does not exceed 25 kg.

The delivery costs are shown as a separate item in the shopping basket and on the invoice.

7. Payment options

Payment must be made in Swiss francs.

Credit cards (Visa, Mastercard, American Express) and debit cards (Postcard, EC, Maestro) are accepted for payment. Any additional fees are detailed during the order process. When paying by credit card or debit card, the amount due is charged to the card after processing by the Swiss Saltworks Logistics Centre.

8. Warranties

Swiss Saltworks warrants the quality and shelf life of its products under the following conditions:

If it can be proved that unrefrigerated food was stored in a cool and dry place, Swiss Saltworks warrants that the delivered products will be free from defects until the best-before date, but at the longest for two years from the date of delivery. The statutory period of two years from the date of delivery applies to products without a best-before date.

Swiss Saltworks can choose whether it wants to meet its warranty obligation by partial or full replacement of a defective product by an equivalent product, by reducing the purchase price, >or by crediting the Customer for the purchase price on the date of the order at most. Any repayments are routed through the method of payment used by the Customer for the original transaction.

There is no general right to return products free of defects that were delivered correctly. All warranties are explicitly excluded for products whose intrinsic quality (e.g. in terms of taste) does not meet the Customer’s requirements, fresh products, products that were spoiled through improper handling or the interruption of the cold chain by the Customer, and products ordered by mistake.

9. Notification of defects

If products are delivered with obvious damage to the packaging or contents, the Customer has to immediately inform the delivery person and refuse acceptance of the delivery, without prejudice to their claims for defects. The Customer is obliged to request a notification of damage from the delivery person. Swiss Saltworks must also be informed about any transport damage without delay.

In addition, the Customer is responsible for checking and correctly storing the products immediately upon receipt. Swiss Saltworks’ Customer Service must be informed on the day of delivery about any defects or deviations, either by phone on +41 61 825 51 15 or by e-mail at ksc@saline.ch. After this date the Customer can only claim for hidden defects, which must be notified to Swiss Saltworks immediately upon discovery.

For a proven defect, the amount paid for the defective goods is credited to the Customer’s account. LeShop.ch reserves the right to request proof of the defect.

10. Liability

Swiss Saltworks in particular does not accept any liability for slight negligence, indirect and direct damage or consequential damage, and loss of earnings, unrealised savings, damage caused by a delay in delivery, and all actions and omissions of auxiliaries.

11. Data privacy

Swiss Saltworks complies with Swiss data protection legislation when capturing and processing personal data. The Data Privacy Statement in the version published on the website of Swiss Saltworks (see https://www.salz.ch/de/privatsphaere-und-datenschutz/) when the online order form is sent by the Customer applies as an integral component to the processing of personal data by Swiss Saltworks.

12. Applicable law and place of jurisdiction

Swiss substantive law applies to the legal relationship between Swiss Saltworks and the Customer, without regard to the conflict-of-law principles and the Vienna sales convention.

The place of jurisdiction for all disputes is Pratteln. Imperative (in part) statutory places of jurisdiction are reserved.

13. Amendments to the GTC

These GTC in the version published on the website become an integral part of the contract at the time when the Customer sends the online order form.

Swiss Saltworks reserves the right to unilaterally amend the GTC at any time. The most recent version is published on the website of Swiss Saltworks.

14. Severability

Should any of the above provisions be ineffective or incomplete, this shall not affect the acceptance and application of the remaining provisions to the contractual relationship between Swiss Saltworks and the Customer. In this case, the contractual parties shall agree to discuss an effective or expanded new provision that comes closest in content to the original intention.
